PRIVACY POLICY for building an Expert Network in canSERV

The following Privacy Policy describes the data protection conditions and requirements when processing personal data in the context of the establishment of an expert network within the canSERV project. 

 

Data Controller

BBMRI-ERIC is the Biobanking and BioMolecular resources Research Infrastructure-European Research Infrastructure Consortium established in December 2013 according to the Commission Implementing Decision of 22 November 2013, 2013/701/EU. The registered address of BBMRI-ERIC is at Neue Stiftingtalstraße 2/B/6, 8010 Graz, Austria.

BBMRI-ERIC is the Coordinator of the Horizon canSERV project, Grant number: 101058620 and the Data Controller of the data collected from experts to build an expert network. BBMRI-ERIC is thus responsible for controlling the ways personal data is collected and the purposes for which personal data is used.

 

Personal data collected from experts

Experts agreeing to have their data collected need to have their data securely processed. BBMRI-ERIC aims at the highest standard for data privacy introduced by GDPR. The Data Controller will collect the experts’ name and email address, gender, title, position, affiliation, country, and city of institution to which they belong, education, specialization, affiliation with canSERV beneficiaries, research scope, information about the Molecular Tumor Boards and Molecular Tumon Boards Network they are part of, including the location (city and country) of the Molecular Tumor Boards.

 

 

Purposes for processing

BBMRI-ERIC collects and processes the above-mentioned personal information with the purpose to establish the European Network for Personalized Oncology (ENPO) and its European Molecular Tumor Board Network (EMTBN), and for dissemination of information regarding the ENPO and EMTBN. The legal basis is the explicit consent from experts in accordance according to the EU GDPR and with the Grant Agreement.

 

 

Sharing data

BBMRI-ERIC will not share the experts’ personal data with third parties for commercial and marketing purposes. In the context of the canSERV project, BBMRI-ERIC will share data only with:

  • Authorised BBMRI-ERIC staff coordinating the canSERV project
  • canSERV consortium members e.g., beneficiaries, associated members, experts etc.

BBMRI-ERIC has taken required technical and organizational measures to ensure that the experts’ personal data is processed exclusively for the purposes mentioned above. BBMRI-ERIC may share the applicants’ personal data with the competent authorities, and only if required to do so by law.

 

Data retention

BBMRI-ERIC keeps the experts’ personal data only for as long as they are needed to establish and operate the ENPO and EMTBN. The information collected will be actively reviewed and when there is no legal or business need to hold the data, then the data will be securely deleted.

 

The data subjects’ rights

Under GDPR, experts are entitled to see copies of all personal data held by BBMRI-ERIC and to amend, correct, delete, or export such data at any time. They can also limit, restrict, or object to the processing of their data. If they want to access their data or exercise any of the above-described rights, they can do so any time by writing to coordination.canserv@bbmri-eric.eu. Any modification or deletion of personal data is valid from the moment of the request onwards, not retroactively.

 

Complaints

If the applicants wish to raise a complaint on how BBMRI-ERIC has handled their personal data, they can contact BBMRI-ERIC addressing the Data Protection Officer (dpo@bbmri-eric.eu). If necessary, they may lodge a complaint about the processing of their personal data with the European Data Protection Supervisor (edps@edps.europa.eu) at any time.
